Subject of the Declaration

By submitting this declaration of consent, you have informed ABB AG, the companies affiliated with ABB AG pursuant to §§ 15 ff. AktG (German Stock Corporation Act) and other companies of the worldwide ABB group (collectively "ABB") that you wish to receive marketing information by e-mail based on your personal interests in ABB's products and services.

In addition to the ability on this website to explicitly indicate your interest in certain products and services and to request marketing information according to your preferences (e.g. via a form), ABB will determine your personal interests based on your active feedback based on existing business relationships with ABB. This includes, but is not limited to, product, business, event or other marketing information expressly requested by you as part of a pre-contractual contact or other request by you (e.g. via the internet, email or telephone or at a trade fair or product event).

Other personal data that you have provided to ABB either on this website or otherwise, or that is already stored in ABB's group-wide, CRM systems and databases, will also be added to your interest profile, specifically personal contact data (e.g. name, title, company, role/function, country, telephone number) and information about the company that employs you (e.g. address, industry and any other information).

Your personal data described in this consent form will be used by ABB to send you marketing information by e-mail (e.g. newsletters, product information or event invitations) about products and services of interest to you. In addition, the data may be used by ABB sales staff to provide you with offers and to provide you or your company with the best possible support.

 

Withdrawal and further information

You have the right to revoke this consent at any time with effect for the future via a link contained in the respective e-mail or by e-mail via the e-mail address  privacy@abb.com.  

Withdrawal will mean that you will no longer receive any future marketing information from ABB based on this consent. Alternatively, and notwithstanding the possibility to withdraw your consent, you may also restrict, extend or otherwise modify the processing of your personal data for marketing purposes at any time by sending an email to the email address privacy@abb.com according to your personal needs and interests.

Who is responsible for the processing of your personal data?

ABB AG, Kallstadter Straße 1, 68309 Mannheim, Germany, or the respective group company affiliated with ABB AG pursuant to §§ 15 et seq. AktG, decides as the "controller" within the meaning of the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG) what and how your personal data is used in accordance with this privacy policy (hereinafter also referred to as "we" or "us").

What personal data we process from you

We have received your personal data either as a result of your registration to receive marketing information, a contractual relationship with you or your company, a pre-contractual contact or another enquiry on your part (e.g. via the Internet, by e-mail or telephone or at a trade fair or product event). In addition, we process, insofar as necessary for the fulfilment of our contractual or legal obligations, personal data which we obtain from publicly accessible sources (e.g. trade register, press, Internet) or which are transmitted to us by other third parties (e.g. a credit agency) on a justified basis.

Relevant personal data includes, in particular, personal details (such as surname, first name, address, bank details, tax number/USt ID) and other contact details (such as telephone number, e-mail address). In addition, this may also include order data (e.g. turnover data or business partner history), data from the fulfilment of our contractual obligations (e.g. payments), information about your financial situation (e.g. creditworthiness data), documentation data (e.g. excerpt from the commercial register) and other data comparable to the categories mentioned. As a rule, we use and store the following categories of your business and/or private personal data: First name, last name, postal address, e-mail address, telephone number, mobile number, fax number, title, academic degree.

 

Why we process your personal data

We process your personal data primarily on the basis of your registration to receive marketing information or other request from you (e.g. via the Internet, by e-mail or telephone or at a trade fair or product event). Your personal data enables us to understand your interest in our products, to develop our business relationship with you and to provide you with the marketing information you request. Your personal data will also be stored in our group-wide database for the processing purposes set out here.

 

Notwithstanding the above, we may process your personal data for the performance of contracts with you or your company or for the performance of pre-contractual measures upon request. In the context of this business relationship between you or your company and us, you must provide personal data that is required for the establishment, implementation or termination of the business relationship and for the fulfilment of the associated contractual obligations, or which we are legally obliged to collect. Without this data, we will generally not be able to establish, maintain or terminate a business relationship with you or to take contractual or pre-contractual measures in response to your request.


Of course, we only collect personal data from you that we need for these processing purposes.

 

On which legal basis we process your personal data

We process personal data in accordance with the provisions of the DSGVO and the BDSG, in particular on the basis of the following legal grounds:

Insofar as we process your personal data to fulfil contractual obligations arising from contracts concluded with you or your company or in the context of pre-contractual measures, the legal basis for such data processing is Art. 6 (1) lit. b) DSGVO.

If we process your personal data on the basis of legal requirements or official measures, for example on the basis of our obligations to comply with tax control and reporting obligations or legal retention periods, the legal basis for such data processing is Art. 6 (1) (c) DSGVO.

To the extent necessary, we process your personal data within the scope of the business relationship with you or your company to protect the legitimate interests of us or of third parties. This is done within the framework of a balancing of interests according to Art. 6 (1) f) DSGVO, according to which the processing is permissible if it is necessary to protect the legitimate interests and the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data, are not overridden.

The use of your personal data for direct marketing purposes is a recognised legitimate interest under Article 6(1)(f) DSGVO. Personal data is processed by us in the context of a business relationship with us (e.g. as a consumer, sole trader or in their role or function in the company). We ensure that you or your company only receive offers that are relevant or of interest to you. Our legitimate interest in this respect is your interest in our products and the business relationship we wish to develop with you.

If and insofar as we process your personal data in exceptional cases for direct marketing purposes without an existing business relationship with you or your company, we require your consent in accordance with Art. 6 (1) a) DSGVO as the legal basis for such data processing. You can revoke this consent at any time in accordance with Art. 7 (3) DSGVO with effect for the future.

Furthermore, we have a legitimate interest in including your personal data in our group-wide CRM systems and databases if you have voluntarily provided us with your data for this purpose (e.g. by handing over your business card or in the context of a contact enquiry) or if we have a contractual relationship or a business relationship with you.

Insofar as we send you marketing information by electronic mail, e.g. newsletters, we also require further consent in accordance with Section 7 (2) No. 3 of the German Unfair Competition Act (UWG) on the basis of applicable law.

 

Who processes your personal data

As part of a global group, we have business relationships with ABB Group companies and external service providers, both within and outside the European Economic Area (EEA), which we may also use to process your personal data.

In this regard, your personal data may also be made available for remote access to ABB Group companies in countries both inside and outside the EEA for the processing purposes set out above. This may include countries whose level of data protection is not comparable to that of the European Union (EU). However, we are committed to a high level of data protection within our group of companies to ensure that your personal data is protected in accordance with the GDPR. In addition, when processing your personal data for the aforementioned purposes, we may use external service providers as processors (e.g. data centres, software companies and marketing automation providers). In particular, the operator of the marketing automation platform used by ABB has the technical ability to access your personal data. Our processors are generally used in accordance with instructions within the framework of an existing contractual relationship and only receive your personal data to the extent and for the period of time that is necessary for the provision of the service. We will also only pass on your personal data to external service providers outside the EEA if it is sufficiently ensured that the data recipient complies with the high level of data protection of the GDPR, for example by concluding standard contractual clauses of the EU Commission in accordance with Article 46 (2) c) of the GDPR.

 

How long we process and store your personal data

We process and store your personal data as long as this is necessary for the above-mentioned processing purposes. In this respect, a regular review takes place.

If your personal data are no longer required for the fulfilment of contractual or legal obligations, they are regularly deleted, unless their temporary further processing is necessary for the fulfilment of commercial and tax retention obligations or for the preservation of evidence within the framework of the legal statute of limitations. In this case, we will retain the personal data concerned until the end of the relevant statutory period.

In addition, we will retain your personal data for as long as is necessary for other relevant processing purposes set out in this Privacy Policy. If you allow us to use your personal data for marketing purposes, we will retain the personal data required for this purpose until you inform us that you no longer wish to receive marketing information and object to the data processing for marketing purposes, or revoke any consent in this regard. If we do not process your personal data for purposes other than marketing (e.g. in the context of business relations or contract performance), this data will be securely deleted in accordance with data protection regulations after receipt of your objection.

Anlage zur Datenschutzerklärung: Deine Rechte als betroffene Person

1. Auskunftsrecht

Du hast das Recht, von uns jederzeit auf Anforderung (Textform) eine Auskunft über deine von uns verarbeiteten personenbezogenen Daten im Umfang des Art. 15 DSGVO zu erhalten. Dieses Recht ist eingeschränkt durch die Ausnahmen des § 34 BDSG, wonach das Auskunftsrecht insbesondere entfällt, wenn die Daten nur aufgrund gesetzlicher Aufbewahrungsvorschriften oder zur Datensicherung und Datenschutzkontrolle gespeichert sind, die Auskunftserteilung einen unverhältnismäßigen Aufwand erfordern würde und eine Zweckentfremdung der Datenverarbeitung durch geeignete technische und organisatorische Maßnahmen verhindert wird.

2. Recht auf Berichtigung

Du hast das Recht, gemäß Art. 16 DSGVO, von uns die unverzügliche Berichtigung der dich betreffenden personenbezogenen Daten zu verlangen, sofern diese unrichtig sein sollten.

3. Recht auf Löschung

Du hast das Recht, unter den in Art. 17 DSGVO genannten Voraussetzungen von uns die Löschung der dich betreffenden personenbezogenen Daten zu verlangen. Diese Voraussetzungen liegen insbesondere dann vor, wenn a) der jeweilige Verarbeitungszweck erreicht ist oder anderweitig wegfällt, b) wir deine Daten unrechtmäßig verarbeiten haben, c) du eine Einwilligung widerrufen hast, ohne dass die Datenverarbeitung auf anderer Rechtsgrundlage fortgeführt werden kann, d) du der Datenverarbeitung erfolgreich widersprechen oder e) in Fällen des Bestehens einer Löschpflicht auf Grundlage des Rechts der EU oder eines EU-Mitgliedstaates, dem wir unterliegen. Dieses Recht unterliegt den Einschränkungen aus § 35 BDSG, wonach das Recht auf Löschung insbesondere entfallen kann, wenn im Falle nicht automatisierter Datenverarbeitungen ein unverhältnismäßig hoher Aufwand für die Löschung besteht und dein Interesse an der Löschung als gering anzusehen ist.

4. Recht auf Einschränkung der Verarbeitung

Du kannst nach Maßgabe des Art. 18 DSGVO von uns verlangen, dass wir deine personenbezogenen Daten nur noch eingeschränkt verarbeiten. Dieses Recht besteht insbesondere, wenn a) die Richtigkeit der personenbezogenen Daten umstritten ist, b) Sie unter den Voraussetzungen eines berechtigten Löschbegehrens anstelle der Löschung eine eingeschränkte Verarbeitung verlangen, c) die Daten für die von uns verfolgten Zwecke nicht länger erforderlich sind, du die Daten jedoch zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen benötigst oder d) der Erfolg eines Widerspruchs noch umstritten ist.

5. Recht auf Datenübertragbarkeit

Du hast  nach Maßgabe des Art. 20 DSGVO das Recht, von uns die d ich betreffenden personenbezogenen Daten, die du uns bereitgestellt hast, in einem strukturierten, gängigen, maschinenlesbaren Format zu erhalten sowie das Recht, dass wir diese Daten einem anderen Verantwortlichen übermitteln.

6. Widerspruchsrecht

Du hast nach Maßgabe des Art. 21 DSGVO jederzeit das Recht, aus Gründen, die sich aus deiner besonderen Situation ergeben, gegen die Verarbeitung dich betreffender personenbezogener Daten, die entweder im öffentlichen Interesse oder zur Wahrung unseres berechtigten Interesses erfolgt, Widerspruch einzulegen.

Danach werden wir die Verarbeitung deiner personenbezogenen Daten einstellen, es sei denn, wir können zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die deiner Interessen, Rechte und Freiheiten überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen. Sofern du der Verarbeitung deiner personenbezogenen Daten zu Marketingzwecken widersprechen, werden wir diese Verarbeitung in jedem Fall einstellen.
